A: Although it is quite rare for a spouse to oppose a simplified divorce it is possible to do so. If your spouse believes that  he/she has a financial claim against you they can  prevent the divorce from proceeding. If your spouse is disputing that you have been separated for the time you stated he/she can also stop the divorce. This would not have to be an end to the matter. If the simplified divorce was opposed we would advise you of the best action to take although it would probably involve raising a different type of divorce action.

A: To be eligible for the Fixed Fee Ordinary Divorce all financial matters and issues relating to matrimonial assets, including the family home have to be sorted out before raising the divorce action. It is very common, if there are financial issues, for people to enter into a written Minute of Agreement. Once that has been done then the Fixed Fee package can be used. A: If you are obtaining your divorce using either of the fixed fee packages you do not have to appear in court.
